1. AGREEMENT TO TERMS

By accessing or using this website and purchasing any products or services from The Piano Keys (“Company,” “we,” “us,” or “our”), you (“you” or “Customer”) agree to be bound by these Terms and Conditions (“Terms”) and all incorporated policies. If you do not agree to these Terms, you must not use this website or purchase any products or services.

2. ELIGIBILITY AND ACCOUNTS

To use this website and make purchases, you must be at least 18 years old or the age of majority in your jurisdiction and have the legal capacity to enter into a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3. DIGITAL PRODUCTS AND SERVICES

The Piano Keys sells digital products and services, including but not limited to:

  • On‑demand piano courses

  • Memberships and subscriptions for course access and related content

  • E‑books and other digital written materials

  • Downloadable sheet music

Unless explicitly stated otherwise, all products are delivered in digital form only. No physical items will be shipped.

4. NO GUARANTEES OF RESULTS

All educational content, including courses, memberships, e‑books, and sheet music, is provided for informational and instructional purposes only and does not constitute a guarantee of any particular musical, professional, financial, or performance outcome. Individual results vary, and your progress depends on many factors outside our control, including your practice time, prior experience, learning style, and effort. Nothing on this website or in our products should be interpreted as a promise or guarantee of specific results.

5. PRICING, BILLING, AND SUBSCRIPTIONS

All prices, fees, and product offerings are subject to change at any time without prior notice, except where a price has already been confirmed at checkout. Taxes, if applicable, will be added at checkout based on the information you provide and our legal obligations.

If you purchase a membership or subscription:

  • Recurring billing details, including price, billing frequency, and any trial period, will be clearly disclosed at checkout.

  • By completing your purchase, you authorize us and our payment processors to charge your chosen payment method on a recurring basis until you cancel in accordance with these Terms.

  • You may cancel future renewals at any time via your account settings (if available) or by contacting us using the contact information provided on the website. Cancellation will take effect at the end of the current billing period, and you will continue to have access to your membership until that time.

  • We do not provide prorated refunds or credits for partially used billing periods, except where required by law.

6. NO REFUND POLICY FOR DIGITAL PRODUCTS

Due to the immediate and non‑returnable nature of digital content, ALL SALES OF DIGITAL PRODUCTS ARE FINAL AND NON‑REFUNDABLE. This includes, without limitation:

  • On‑demand piano courses

  • Memberships and subscriptions (including recurring payments once processed)

  • E‑books and other downloadable written materials

  • Downloadable sheet music

Once access to a digital product is granted, a membership period begins, or a download link is provided, you are not entitled to a refund, exchange, or store credit, except where a refund is required by applicable law (for example, if the product is defective or not as described).

If you experience a technical issue that prevents you from accessing a purchased product, you must contact us within a reasonable time and cooperate with our efforts to resolve the issue. In such cases, our responsibility is limited to providing access to the product you purchased or an equivalent solution, where possible.

7. SPECIAL NOTICE FOR EU/EEA/UK CUSTOMERS

If you are located in the European Union, European Economic Area, or the United Kingdom, you may have statutory rights regarding digital content, including a right of withdrawal for certain online purchases. By purchasing digital content from The Piano Keys, you acknowledge and agree that:

  • You request and consent to the immediate performance of the contract and immediate access to the digital content.

  • You understand that once access is granted or a download begins, you lose any statutory right of withdrawal for that digital content, to the extent permitted by applicable law.

Your mandatory consumer rights (such as rights regarding defective or non‑conforming digital content) remain in force and are not excluded by these Terms.

8. LICENSE AND INTELLECTUAL PROPERTY

All content on this website and within our products, including but not limited to videos, audio files, text, images, e‑books, sheet music, exercises, and other instructional materials (“Content”), is owned by The Piano Keys or our licensors and is protected by copyright and other intellectual property laws.

Upon purchase and subject to these Terms, you receive a limited, non‑exclusive, non‑transferable, revocable license to access and use the Content solely for your personal, non‑commercial use. You may not:

  • Allow others to access the Content using your account;

  • Remove, alter, or obscure any copyright or proprietary notices;

  • Bypass or attempt to bypass any digital rights management or technical protection measures.

Any use of the Content not expressly permitted by these Terms is strictly prohibited and may result in termination of your access without refund, in addition to any other legal remedies available to us.

9. USER CONDUCT

You agree not to use the website or our Content for any unlawful, harmful, or disruptive activity, including but not limited to:

  • Violating any applicable law or regulation;

Without limiting the foregoing, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the website or Content will be uninterrupted, error‑free, secure, or free of viruses or other harmful components, or that any defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, the exclusions shall apply to the fullest extent permitted by applicable law.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall The Piano Keys, its owners, officers, employees, contractors, or agents be liable for any indirect, incidental, consequential, special, or punitive damages, including without limitation lost profits, lost data, loss of goodwill, or other intangible losses, arising out of or related to your use of or inability to use the website, Content, or products.

To the maximum extent permitted by law, our total aggregate liability for any and all claims relating to your use of the website, Content, or products shall not exceed the total amount paid by you for the specific product or service giving rise to the claim in the three (3) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of these limitations may not apply to you. In such cases, the limitations shall apply to the fullest extent permitted by applicable law.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Piano Keys and its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the website, Content, or products;

  • Your violation of these Terms; or

  • Your infringement of any intellectual property or other rights of any third party.

13. CHANGES TO TERMS

We may update or modify these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Any changes will be effective when posted, unless otherwise stated. Your continued use of the website or products after any changes have been posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the website and products.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any dispute arising out of or relating to your use of the website, Content, or products shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law principles.

Subject to any mandatory consumer protection rules that apply to you based on your residence, you agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Collin County, Texas, and you hereby consent to the personal jurisdiction and venue of such courts.

You and The Piano Keys may also agree in writing to pursue alternative dispute resolution methods such as mediation or arbitration, in which case the terms of that agreement will supplement this section.

By using this website, creating an account, or making a purchase, you consent to receive communications from us electronically, including emails, notices, disclosures, and other information, which satisfy any legal requirement that such communications be in writing. You indicate your agreement to these Terms by checking an “I agree” box, clicking a button labeled with acceptance language, or continuing to use the website after being presented with a link to these Terms.
